TikTok is set to appear before the US Supreme Court today in a final effort to overturn a looming ban, a case that raises questions about national security and free speech.
The platform is contesting a law passed last year that requires TikTok to either separate from its Chinese parent company or face a US ban by 19 January. The US government argues that TikTok, if not sold, could be exploited by China for surveillance or political interference.
TikTok denies these claims, calling the law discriminatory and a violation of the free speech rights of its 170 million American users.
While lower courts have ruled in favor of the government, the case took a twist last month when President-elect Donald Trump requested a delay in enforcing the law to explore a resolution. Analysts note that overturning the prior ruling would be rare, even with the president-elect’s involvement. A Supreme Court decision could come within days.
The legislation, passed with bipartisan support in Congress, does not ban TikTok outright but would require tech companies like Apple and Google to remove it from app stores and block updates—moves analysts say could effectively end its presence in the US.
TikTok is already banned on government devices in multiple countries, including the UK, and faces outright bans in places like India.
